Overview
These Terms & Conditions (the “Terms”) govern your use of the Cremation Air LLC website (the “Site”) and the purchase of services from Cremation Air LLC (“Cremation Air,” “we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms.
Key Definitions
Client: The licensed funeral home, funeral director, or authorized agent placing an order.
Family: The next-of-kin or authorized individual represented by the Client.
Service: The unattended aerial scattering of cremated remains performed by or on behalf of Cremation Air LLC.
Authorized Client Relationship
Cremation Air LLC contracts exclusively with licensed funeral homes, funeral directors, or authorized agents. Families are represented solely through the Client, and the Client is solely responsible for securing appropriate authorizations. No direct contractual relationship exists between Cremation Air LLC and the Family.
Eligibility & Representation
By placing an order, the Client represents that they are authorized to arrange the Service and that all information provided is accurate and complete. The Client agrees to comply with all applicable laws and regulations regarding the handling and disposition of cremated remains.
Orders & Acceptance
Orders are deemed accepted when Cremation Air LLC issues an order confirmation. We may decline or cancel an order if we cannot complete the Service safely, lawfully, or in accordance with our policies.
Scheduling & Weather
Scattering flights are subject to weather, safety, regulatory, and air traffic control conditions. Estimated dates are estimates only and may change due to factors beyond our control, including weather, mechanical issues, acts of God, or other force majeure events. If rescheduling is required, Cremation Air LLC will provide in it’s sole discretion, earliest available alternative date at no additional cost.
Certificates & Video
Cremation Air LLC will provide a Certificate of Aerial Scattering and a digital video after the Service is completed. While every effort is made to ensure accuracy and quality, technical malfunctions, data corruption, or equipment failure shall not constitute a failure of the Service itself or result in any liability to Client for Damages. Delivery timelines may vary based on operational factors.
Intellectual Property
All content on the Site is owned by Cremation Air LLC or its licensors and is protected by law. You may not copy, modify, or use our intellectual property without permission.
Pricing & Taxes
All prices are in U.S. dollars and subject to change prior to order acceptance. Applicable taxes and fees will be added at checkout.
Regulatory Compliance
Cremation Air LLC conducts all Services in accordance with applicable FAA regulations, EPA requirements, and USPS guidelines. Scheduling and completion of Services are expressly subject to these requirements, and Cremation Air LLC reserves the right to delay, reschedule, or decline Services where compliance would otherwise be compromised.
Disclaimers & Limitation of Liability
Services are provided on an “as-available” basis and are subject to safety, weather, and regulatory requirements. Cremation Air LLC is not responsible for delays or changes caused by weather, air traffic control, FAA directives, aircraft maintenance, carrier delays, or any other events outside our control.
Other than what is expressly stated in these Terms, Cremation Air LLC makes no additional promises or guarantees about its Services. This includes disclaiming any implied warranties under law, such as guarantees that the Service is suitable for a particular purpose, meets all personal expectations, or is free from outside claims.
To the maximum extent permitted by law, Cremation Air LLC is not liable for indirect, incidental, special, or consequential damages, and in all cases our total liability shall not exceed the amount paid for the Service.
Indemnity
The Client agrees to indemnify and hold Cremation Air LLC harmless from claims, damages, or losses arising out of (i) breach of these Terms; (ii) inaccurate authorization or documentation; or (iii) failure to comply with shipping/packaging instructions.
Governing Law & Venue
These Terms are governed by the laws of the Commonwealth of Pennsylvania and the State of Florida, without regard to conflict-of-law principles. Any dispute shall be resolved through binding arbitration in Delaware County, PA or Tampa, FL under the rules of the American Arbitration Association. If court action is required, exclusive jurisdiction lies with the state or federal courts located in Delaware County, Pennsylvania or Tampa, Florida.
Changes to Terms
We may update these Terms at any time. The revised version will be effective as of the “Last updated” date above.
